MDA Privacy Office

The Missile Defense Agency (MDA) recognizes the importance of protecting the privacy of individuals, especially as it modernizes and develops its information technology (IT) systems.

The Defense Privacy Office is responsible for implementation of the Department of Defense (DoD) Privacy Program. The Program is based on the Privacy Act of 1974, as amended (5 U.S.C. 552a), as implemented by Office of Management and Budget (OMB) (OMB Circular A-130) and DoD regulatory authority (DoD Directive 5400.11 and DoD 5400.11-R), and is intended to provide a comprehensive framework regulating how and when the Department collects, maintains, uses, or disseminates personal information on individuals. The purpose of the Program is to balance the information requirements and needs of the Department against the privacy interests and concerns of the individual.

Privacy Impact Assessments

Section 208 of the E-Government Act of 2002 establishes Government-wide requirements for conducting, reviewing, and publishing Privacy Impact Assessments (PIA). These assessments explain how the MDA factors in privacy issues for all new or significantly altered IT systems or projects that collect, maintain, or disseminate information in identifiable form from or about members of the public — excluding information on DOD personnel. Although the PIA requirement normally excludes DOD personnel, privacy implications are considered by MDA for all systems and collections that involve information in identifiable form for all American citizens and permanent resident aliens.

In September 2003, the OMB issued OMB Memorandum 03-22, "OMB Guidance for Implementing the Privacy Provisions of the E-Govt Act of 2002," to agencies implementing the privacy provisions of the E-Government Act.

The Department of Defense (DoD) Privacy Impact Assessment (PIA) Guidance provides procedures for the completion and approval of PIAs in the Department of Defense to meet the statutory requirement as stated in Section 208 and in support of OMB Memorandum 03-22.
